Recent FOIAs Highlight Need for Openness in DC Housing Policy Discussions &amp; Decisions<\/b><\/i><\/font><\/div>\n<div style=\"font-size:10pt;font-family:Verdana,Geneva,sans-serif\"><font size=\"4\"><b><br \/><\/b><\/font><\/div>\n<div style=\"font-size:10pt;font-family:Verdana,Geneva,sans-serif\"><font size=\"4\"><b>Washington, DC <\/b>\u2014 Residents with <a href=\"www.savedcpublicland.org\/the1617project\">Save DC Public Land: The 1617 Project<\/a> have filed two Freedom of Information Act (FOIA) requests recently.<\/font><\/div>\n<div style=\"font-size:10pt;font-family:Verdana,Geneva,sans-serif\"><\/div>\n<div style=\"font-size:10pt;font-family:Verdana,Geneva,sans-serif\"><font size=\"4\"><b>FOIA #1<\/b> &#8212; The first FOIA was delivered to the DC Zoning Office to better understand why its taken more than a year for the DC Zoning Commission to issue a written order regarding <a href=\"https:\/\/savedcpublicland.org\/the1617project\/2025\/11\/21\/foia-filed-with-dc-zoning-commission-on-1617-u\/\">the future of 1617 U Street \u2013 ZC Case No. 23-02<\/a>.<\/font><br \/><b><br \/><\/b><font size=\"4\"><b>FOIA #2<\/b> &#8212; The second FOIA seeks records from ANC 1B02 Commissioner Francois Barrilleaux regarding his recent drafting and introduction of \u201cA Resolution Urging Gentle Density Throughout the District of Columbia\u201d (<a href=\"https:\/\/www.anc1b.org\/announcements\/december-2025-agenda\">available at page 36 of the ANC 1B December agenda PDF<\/a>).<br \/><\/font><\/div>\n<div style=\"font-family:Verdana,Geneva,sans-serif\"><font size=\"4\"><br \/><\/font><\/div>\n<div style=\"font-size:10pt;font-family:Verdana,Geneva,sans-serif\"><font size=\"4\">FOIA requesters note that <u><b>none of the proposed<\/b> ANC Gentle Density resolution\u2019s recommended\u00a0<b>land use changes would require the creation of affordable, family-sized homes<\/b><\/u>, despite the city\u2019s acute need for lower-cost three- and four-bedroom units. And, <u>the proposal would unironically eliminate ANC consultation<\/u> on the teardowns of single family homes and small apartment rebuilds. <\/font><\/p>\n<p><font size=\"4\">FOIA requestors seek communications that the proposing-Commissioner may have had while drafting the resolution with representatives of <b>Greater Greater Washington, the American Enterprise Institute<\/b> (where Commissioner Barrilleaux is employed), among others.<\/font><\/p>\n<blockquote><p><font size=\"6\"><i>\u201cWhen a local ANC resolution mirrors proposals from organizations promoting market-first approaches and wholesale housing-policy deregulation, the public deserves to know how it was shaped and why,\u201d<\/i> said Marcy Logan, one of the FOIA requesters who has property on Seaton Street.<\/font><\/p><\/blockquote>\n<p><font size=\"4\">The controversial \u201cgentle density\u201d proposal would grant DC\u2019s real estate industry broad new by-right permissions to demolish single-family homes and replace them with rowhouses or small apartment buildings of 4 to 6, possibly 8, units\u2014without specifying affordability outcomes and with no further community dialogue (\u201cby-right\u201d).<\/font><\/div>\n<div style=\"font-family:Verdana,Geneva,sans-serif\"><font size=\"4\"><br \/><\/font><\/div>\n<div style=\"font-size:10pt;font-family:Verdana,Geneva,sans-serif\"><font size=\"4\">At a recent meeting, 1B neighbors warned that such policy changes could have far-reaching adverse effects on residential areas across the city, particularly in Wards 4, 5, 7, and 8, where neighborhoods are more vulnerable to speculative displacement:<\/font><\/p>\n<p style=\"line-height:115%;margin-left:0.5in;border:none;padding:0in\" align=\"left\"><span style=\"font-size:14pt;,times,serif\"><i><br \/>&#8220;The discussion seems to show that if these policies were enacted, they really wouldn&#039;t have much of an impact on ANC1B or our ward,\u201d <\/i>stated <a href=\"https:\/\/youtu.be\/6p9Xk6vy6Pw?si=qrAZqIkqU8iXIiSq&amp;t=6677\" target=\"_blank\"><span style=\"color:#1155cc\"><u><b>Howard Kurtzman, 1B neighbor and member of the 1B Economic Development Committee<\/b><\/u><\/span><\/a>.<i> \u201cThey would have an impact on other wards and neighborhoods like Cleveland Park and Crestwood and elsewhere. I don&#039;t think \u2026 residents of those neighborhoods will take kindly to these proposed policies. &#8230; My preference would be to just table it because it&#039;s just not in the domain of this ANC.&#8221;<\/p>\n<p><\/i><\/span><\/p>\n<p style=\"line-height:115%;margin-left:0.5in\"><span style=\"font-size:14pt;font-family:helvetica,arial,sans-serif\"><span style=\",times,serif\"><i><u><span style=\"font-weight:normal\">I think it&#039;s absolutely wrong for [ANC1B] to take a position and issue something that if it was done to us in the reverse, we would definitely not appreciate it.<\/span><\/u><\/i><i> So, I think that that is not the way we should go&#8230; to move forward without any input of the people that [this proposal] would actually affect is problematic,\u201d <\/i>stated <a href=\"https:\/\/youtu.be\/6p9Xk6vy6Pw?si=gsZ8JopdVsyUjv4D&amp;t=8069\" target=\"_blank\"><span style=\"color:#1155cc\"><u><b>Tania Shand, 1B neighbor and participating member of the ANC 1B Economic Development Committee<\/b><\/u><\/span><\/a><b>.<\/b><\/span><b><br \/><\/b><\/span><\/p>\n<p><font size=\"4\">The FOIA cites notable similarities between the draft ANC resolution and recent policy positions advanced by both <b><a href=\"https:\/\/ggwash.org\/view\/101486\/a-modest-proposal-to-bring-homeownership-back-in-the-district\">GGW<\/a><\/b> and <b><a href=\"https:\/\/www.aei.org\/op-eds\/a-light-touch-could-bring-homeownership-back-in-the-district\/\">AEI<\/a><\/b>\u2014organizations known for market-driven deregulation and pro-growth housing proposals, typically promoting increased density without meaningful race- or class-impact analysis.\u00a0<\/font><\/div>\n<div style=\"font-family:Verdana,Geneva,sans-serif\"><font size=\"4\"><br \/><\/font><\/div>\n<div style=\"font-family:Verdana,Geneva,sans-serif\"><font size=\"4\"><b>The FOIA request also references long-standing concerns about displacement in the District over the past two decades (60,000 Black residents gone)(1 in 4 Black residents displaced from Ward 1 over the past decade alone).<\/b><\/font><\/div>\n<div style=\"font-family:Verdana,Geneva,sans-serif\"><font size=\"4\"><br \/><\/font><\/div>\n<div style=\"font-family:Verdana,Geneva,sans-serif\"><font size=\"4\">FOIA requestors seek all communications, emails, messages, and documents from August 1 to December 4, 2025, to and from Commissioner Barrilleaux in his official capacity as an ANC commissioner regarding the proposed \u201cGentle Density\u201d resolution.<\/p>\n<p>Save DC Public Land is an organization advocating for greater affordability and the production of family-sized housing using DC\u2019s limited public land and assets, including a proposed social-housing pilot on the 2 acres of public land at 1617 U Street NW. <a href=\"http:\/\/www.savedcpublicland.org\/the1617project\">www.savedcpublicland.org\/the1617project<\/a><\/font><\/div>\n<div style=\"font-family:Verdana,Geneva,sans-serif\"><font size=\"4\"><br \/><\/font><\/div>\n<div style=\"font-size:10pt;font-family:Verdana,Geneva,sans-serif\"><font size=\"4\">The campaign emphasizes that transparency is essential in the lead-up to the Comprehensive Plan 2050 update, where zoning concepts included in the resolution may be considered on a citywide scale.
