{"id":440,"date":"2024-01-10T00:02:00","date_gmt":"2024-01-10T00:02:00","guid":{"rendered":"https:\/\/savedcpublicland.org\/the1617project\/?p=440"},"modified":"2026-02-10T01:25:39","modified_gmt":"2026-02-10T01:25:39","slug":"1617-u-street-zoning-hearing-tonight-likely-to-be-cancelled-read-more","status":"publish","type":"post","link":"https:\/\/savedcpublicland.org\/the1617project\/2024\/01\/10\/1617-u-street-zoning-hearing-tonight-likely-to-be-cancelled-read-more\/","title":{"rendered":"1617 U Street: Zoning Hearing Continued Again Until Thursday, January 29, 2024"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">On Monday, June 26, 2023, the Mayor had expected the DC Zoning Commission to rubber-stamp upzoning of 1617 U Street to high-density, allowing a future building to be constructed at the site of the police station and fire station exceeding 100 feet in height and 80% lot occupancy.<\/p>\n\n\n\n<div align=\"center\"><iframe loading=\"lazy\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/enWv2BqooL4?start=891\" title=\"YouTube video player\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" allowfullscreen><\/iframe><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">As seen in the video above, the Zoning Commission instead postponed the hearing, resetting it down as a &#8220;contested case&#8221; after <strong><a href=\"https:\/\/app.dcoz.dc.gov\/CaseReport\/ViewExhibit.aspx?exhibitId=314050\">receiving comments from lawyers and neighbors<\/a><\/strong> alleging improper notice and an error in the administrative process.  The next hearing on the matter will be on <strong><a href=\"https:\/\/savedcpublicland.org\/the1617project\/testify\/\" data-type=\"page\" data-id=\"398\">JANUARY 22, 2024 (new date)<\/a>.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Then on November 20, 2023, the Zoning Commission postponed the hearing again for a malformed notice <strong><a href=\"https:\/\/app.dcoz.dc.gov\/CaseReport\/ViewExhibit.aspx?exhibitId=327444\" target=\"_blank\" rel=\"noreferrer noopener\">that did not properly inform neighbors of their rights to participate as parties<\/a><\/strong>.<\/p>\n\n\n\n<div align=\"center\"><iframe loading=\"lazy\" width=\"560\" height=\"315\" src=\"https:\/\/www.youtube.com\/embed\/RpcSpMTtW1g?si=b2jKzKzfcbPz7_hx&amp;start=923\" title=\"YouTube video player\" frameborder=\"0\" allow=\"accelerometer; autoplay; clipboard-write; encrypted-media; gyroscope; picture-in-picture; web-share\" allowfullscreen><\/iframe><\/div>\n\n\n\n<hr class=\"wp-block-separator has-alpha-channel-opacity\"\/>\n\n\n<div class=\"postie-post\">\n<div dir=\"ltr\">\n<div class=\"gmail_quote\">\n<div dir=\"ltr\">\n<div class=\"gmail_quote\">\n<div dir=\"ltr\">\n<div class=\"gmail_quote\">&nbsp;<\/div>\n<div class=\"gmail_quote\"><b><i>For more background read the links below:<\/i><\/b><\/div>\n<div>&nbsp;<\/div>\n<div class=\"gmail_quote\">An attorney representing the <i>Coalition for Affordable Housing, Not Luxury Housing!<\/i> submitted two letters (<b><a href=\"https:\/\/app.dcoz.dc.gov\/CaseReport\/ViewExhibit.aspx?exhibitId=314050\" target=\"_blank\" rel=\"noopener\">letter one<\/a><\/b>, <b><a href=\"https:\/\/app.dcoz.dc.gov\/CaseReport\/ViewExhibit.aspx?exhibitId=315796\" target=\"_blank\" rel=\"noopener\">letter two<\/a><\/b>) to the Zoning Commission challenging the fact the case was set down wrongly as a rule-making case, instead of a contested case.&nbsp;<\/div>\n<div class=\"gmail_quote\">&nbsp;<\/div>\n<div class=\"gmail_quote\">There is apparently a big administrative difference, as explained by the attorney&#8217;s letter:<span style=\"font-size: large;\"><span style=\"background-color: #fff2cc;\"><br \/><\/span><\/span><\/div>\n<div class=\"gmail_quote\" style=\"margin-left: 40px;\"><i>&#8220;Unlike in a contested case, in a rulemaking case there are no parties, no right to call witnesses, no right to cross-examination, no right to a direct appeal to the DC Court of Appeals, no required weighing by the Commission of the effects on neighboring properties of light, air, traffic congestion, etc., of the proposed map amendment, no required notice by letter or email&nbsp; of this public hearing &#8220;to owners of all property within two hundred feet (200 ft.)&#8221; of these Parcels as would otherwise be required under Subtitle Z&nbsp; \u00a7 402.1.&#8221;&nbsp; <\/i><\/div>\n<div class=\"gmail_quote\" style=\"margin-left: 80px;\">&nbsp;<\/div>\n<div class=\"gmail_quote\">And many nearby neighbors complained of not receiving any notice from the Office of Planning about this propose high-density rezoning &#8212; <a href=\"_wp_link_placeholder\" data-wplink-edit=\"true\"><strong>click here.<\/strong><\/a><\/div>\n<div>&nbsp;<\/div>\n<div class=\"gmail_quote\">On the day of the hearing, apparently the Mayor&#8217;s attorneys and the Office of Planning agreed that there was an error and the case should proceed as a contested case versus a rulemaking case.&nbsp;
